Terms & Conditions

By signing a job quote, booking a service, or engaging Mountain AV (“we”, “us”, “our”), you (the “client” or “customer”) agree to the following terms and conditions.


1. General Services & Callout Policy

  1. Mobile Service: We operate as a mobile service (“We come to you”) serving the Gold Coast, Brisbane, and surrounding regions.
  2. Quotations: Quotes provided are valid for 30 days unless otherwise specified. Any additional work or parts required outside the initial scope will be discussed and agreed upon prior to commencement.

2. Computer & IT Services

2.1 Data Backup Responsibility

  • Client Responsibility: It is the client’s sole responsibility to perform a complete backup of all critical data—including photos, videos, documents, software installers, licence keys, browser bookmarks, and passwords—prior to handing over or booking in equipment for diagnostic, repair, or upgrade services.
  • Inquiries & Assistance: If you are uncertain how to back up your data or need assistance with the backup process, please let our team know. We are committed to minimising data loss risks and can assist you with backup solutions before work begins.
  • Unforeseen Hardware Failure: While Mountain AV exercises utmost professional care when servicing systems, we cannot guarantee against pre-existing drive degradation or unforeseen hardware failures during data-intensive procedures.

2.2 Hard Drive / SSD Upgrades & Default Data Transfer

  • Setup Preferences: It is your responsibility to communicate specific preferences regarding software configuration and data migration. If you require a like-for-like system clone or fresh installation, please specify when booking.
  • Drive Disposal: Replaced storage drives can be returned to you or securely wiped and formatted by Mountain AV prior to responsible recycling/disposal.
  • Default Data Transfer: Unless specific instructions are provided, standard data migrations include:
    • Documents, photos, videos, and personal files
    • Browser bookmarks
    • Saved licence keys and Wi-Fi login profiles (where technically accessible)
  • Software Installation: You must specify any software applications you require installed. Mountain AV will make every effort to accommodate your requests and may recommend suitable, stable, or open-source software alternatives where appropriate.

2.3 Outdated Software & Hardware Policy

  • Advisory & Notice: Mountain AV is dedicated to system security. We will inform you of any known security vulnerabilities or end-of-life (EOL) status affecting outdated operating systems (e.g., legacy Windows or macOS versions) or obsolete hardware.
  • Client Decision: The final decision to upgrade or continue operating unsupported systems rests with you.
  • Limitation of Liability: Mountain AV cannot be held liable for damages, security breaches, malware/ransomware infections, or data loss resulting from the ongoing use of unsupported or discontinued software or hardware.

2.4 Remote Support Software

To assist with ongoing troubleshooting and maintenance, we may install remote support software (such as MeshCentral). This is self-hosted on our own private infrastructure (not routed through third-party cloud brokers). Remote sessions are only initiated with your knowledge and authorization.

2.5 “No Fix, No Fee” Policy & 3-Month Warranty

  • No Fix, No Fee: If we are unable to diagnose or propose a viable solution for your computer issue due to technical impossibility, no labour fee is charged. (This policy does not apply if a diagnosis and solution are provided but the client elects not to proceed with recommended parts or repairs).
  • 3-Month Workmanship Warranty: We stand behind the quality of our work. All repair labour and IT configuration work carried out by Mountain AV is backed by a 3-month warranty. Hardware and replacement parts carry their respective manufacturer warranties.

3. AudioVisual, Recording & Event Production

  1. Bookings & Venue Access: Event dates and production setups are confirmed upon quotation acceptance. The client is responsible for ensuring reasonable access to the venue and adequate setup time.
  2. Power & Off-Grid Requirements: For outdoor or off-grid events, power requirements (generator capacity, weather protection) must meet agreed safety standards to safeguard equipment, performers, and attendees.
  3. Safety & Equipment Care: Mountain AV equipment on-site is operated under professional standards. Clients and venue hosts must ensure a safe operating environment free from hazards or deliberate interference.
  4. Cancellations: Event cancellations made close to the scheduled event date may be subject to a cancellation fee to cover reserved equipment, transport, and preparation time.

4. Digital Media & Content Creation Terms

When utilizing website, digital media, audio recording, or content creation services provided or managed by Mountain AV, you agree to the following:

  1. Legal & Ethical Compliance: Content must comply with applicable Australian laws and must not promote discrimination, harassment, violence, or harm against any group or individual.
  2. Prohibition of Malicious Content: Content must not be used for deceptive practices, spam, or distributing malicious software.
  3. Accuracy & Ownership: You are responsible for ensuring the accuracy and intellectual property ownership (or necessary licensing) of all client-supplied text, logos, audio, and imagery.
  4. Not Safe for Work (NSFW) Prohibition: We strictly prohibit the use of our services or hosting infrastructure for sexually explicit or NSFW materials.
  5. Open Source Collaboration: When resolving software bugs in third-party or open-source tools, technical diagnostic details may be shared with developer communities to improve software reliability. Reasonable steps are taken to redact any sensitive personal information.
  6. Indemnification: You agree to indemnify and hold Mountain AV harmless against any claims, losses, or legal liabilities arising from client-provided materials or misuse of digital media services.

5. Invoicing & Payment Terms

  • Invoices are issued upon completion of IT services or as agreed for event production milestones.
  • Payment is due upon receipt or within the timeframe specified on the tax invoice.
  • Accepted payment methods include bank transfer (EFT) and accepted electronic payment methods.

6. Australian Consumer Law & Governing Law

Nothing in these terms excludes, restricts, or modifies any consumer rights or statutory guarantees provided under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law (ACL) that cannot be excluded by law.

These terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising in connection with these terms shall be subject to the jurisdiction of the courts of Queensland.
